Surface Damage Release

A surface damage release is a signed document in which a landowner accepts compensation and releases claims for damage to the surface from construction or operations, such as a pipeline installation. It often accompanies an easement or surface use agreement. By signing, the landowner acknowledges the agreed compensation and waives further claims for the specified surface harm, protecting the operator from later disputes. It is typically executed after construction once the actual damage is assessed.

Example
Once the pipeline trench is backfilled across the Mercer farm, Lone Star Pipeline pays $11,000 and the Mercers sign a surface damage release covering the lost hay crop and compacted soil, closing out claims for that construction damage.
